Transparency on the use of artificial intelligence.

1. Why this page exists

This page sets out clearly and honestly how and where Phaenomena S.p.A. uses artificial intelligence tools in building and running its website, in accordance with the transparency obligations of Regulation (EU) 2024/1689 (the “AI Act”), whose obligations apply in stages from 2 February 2025. It is not an independent certification, but a commitment to transparency towards those who visit our site.

2. Our role under the AI Act

Under Article 3 of the Regulation, Phaenomena S.p.A. acts solely as a deployer of artificial intelligence tools developed by third parties. We do not develop, train or place on the market artificial intelligence models, nor high-risk systems listed in Annex III to the Regulation.

3. Where and how we use artificial intelligence

3.1 Decorative images

Some purely decorative or background images (for example on the home page) are generated or processed with artificial intelligence tools. These are solely ancillary graphic elements: photographs of our products and of completed installations always depict real products and real projects and are not images generated by artificial intelligence. They may, however, have been optimised with digital tools, including AI-based ones, for presentation purposes only: correction of brightness, contrast and colour, cut-out or background removal, and removal of elements extraneous to the scene. The images are therefore purely illustrative and may not faithfully reproduce shades, finishes and proportions: for the appearance, dimensions and characteristics of the products, only the PDF datasheets are authoritative.

3.2 Textual content

Some texts on the site have been generated with the aid of artificial intelligence tools, with a level of editorial review that varies from page to page. We are committed to a process of progressive content verification; if you notice any inaccurate information, in particular on technical product data, please report it to us via the Contatti — the official technical specifications remain in any case those set out in the PDF datasheets of the individual products.

3.3 Website development tools

The site has also been built with the aid of generative artificial intelligence assistants as a support tool for programming and writing, always under the supervision and final approval of human staff before publication.

3.4 Foreign-language versions

The English, German, Spanish and French versions of this site are translations produced with the aid of generative artificial intelligence tools. They are not sworn or certified translations, and have not been produced by certified professional translators. Before publication they undergo internal editorial review by Phaenomena S.p.A. staff, who assume editorial responsibility for them under Article 50 of Regulation (EU) 2024/1689; that review does not, however, amount to professional linguistic or legal validation.

The Italian version is the only authoritative one. In the event of any difference, discrepancy or doubt as to interpretation between the language versions, the Italian text prevails in all cases. The translations are provided as a courtesy, to aid understanding, and do not constitute an independently binding text.

This applies in particular to:

• pages with legal effect (privacy notice, cookie policy, whistleblowing procedure and this page), whose binding text remains the Italian one;
• the registered designations of patents, trade marks, designs and models, which remain in the original language of filing and are authoritative solely in the wording registered with UIBM and EUIPO, together with the relevant filing number;
• technical data, declared performance and product specifications, whose official details remain exclusively those set out in the PDF datasheets and in the certification documentation;
• any technical or regulatory term, for which the Italian wording is the verified one.

Phaenomena S.p.A. does not warrant that the translated versions are free from inaccuracies and accepts no liability for decisions taken on the basis of a foreign-language version alone. For any contractual, technical or legal assessment we invite you to refer to the Italian text and to contact us directly. If you find an inaccuracy in a translated version, please report it to us: we will correct it.

4. What we do not use

For completeness, we state explicitly what is not present on our site to date:

• No conversational assistant or automated chatbot addressed to visitors
• No artificial-intelligence-based search system
• No AI-based automated product recommendation system
• No automated decision producing legal effects or significantly affecting visitors or customers
• No biometric recognition or biometric categorisation system
• No predictive profiling or social scoring system

If we introduce any of these tools in future, we will update this page before activating them.

5. Prohibited practices (Art. 5): declaration

Phaenomena S.p.A. declares that it does not use artificial intelligence for any of the practices prohibited by Article 5 of the Regulation: no cognitive or subliminal manipulation, no exploitation of the vulnerabilities of specific groups of people, no social scoring of natural persons, no real-time biometric identification in public spaces, no biometric categorisation for sensitive data, no predictive policing based on profiling, no inference of emotions in the workplace.
